Clarification Regarding the Age of Retirement of Employees KPK
I am directed to refer to the subject noted above and to state that various flied offices are approaching this department to seek clarification regarding retirement age and eligibility for premature retirement in wake of recent amendment in Khyber Pakhtunkhwa Civil Servant Act, 1973 and legality/applicability of notifications issued prior to the subject amendment, which allowed the incumbents to retire upon attaining the age of 60 years on or after 1-07-2019.
I am accordingly directed to clarify that all those employees who attained the age of 60 years before 31-07-2019 are eligible for retirement on superannuation. However, the employees who attained the age of sixty years on or after 31-07-2019 have to serve till attaining the age of 63 years. Further, the conditions of 25 years qualifying services as well as attaining the age of 55 years are pre-requisite for premature retirement w.e.f. 31-07-2019.
I am further directed to inform you that the competent authority has been pleased withdraw all notifications issued bythis section, which are violation of the provisions of KPK Civil Servants (Amendment) Act, 2019.
All Directorates / District Education Offices are also directed to withdraw such defective retirement orders issued bytheir respective offices.
